Terms of Service

No. (IČO): 71937501, registered address: Ohnišťanská 84/2, 193 00 Praha, Czech Republic ("Diffmon", "we", "us"). Diffmon operates the change monitoring service described below.

These Terms of Service ("Terms") govern your access to and use of Diffmon (the "Service"). By creating an account, using the Service, or placing an order, you agree to these Terms on behalf of yourself or the organization you represent (the "Customer"). If you do not agree, do not use the Service.

Business use only

The Service is intended solely for business and professional use. By creating an account or purchasing a subscription, you represent and warrant that you are acting in the course of your trade, business, or profession and not as a consumer. Consumer protection laws, including statutory withdrawal rights applicable to consumers, do not apply to the extent permitted by law.

Definitions

"Customer Content" means (a) monitor configurations and settings, (b) monitored targets (URLs/APIs), (c) retrieved responses and rendered outputs, (d) snapshots, diffs, incident records and derived metadata generated by the Service from Customer-configured targets, and (e) notification destination configuration (including destination URLs).

Service description

Diffmon monitors websites and APIs, stores snapshots and diffs, and delivers notifications (email/webhooks) about detected changes. The Service is change monitoring, not uptime monitoring, and does not guarantee detection of every change or prevention of downstream failures.

Workspace and users

The Service is organization/workspace-based. The Customer is responsible for all activity under its workspace, including actions taken by invited members and API tokens.

Customer responsibilities

You must ensure that you have the legal right to monitor each target (URL/API) you configure and to process any content retrieved. You are responsible for your configurations, ignore/extract rules, and notification routing. You must keep your credentials and access tokens secure.

Acceptable use

You must not use the Service to violate laws, infringe rights, harvest personal data unlawfully, or attempt to bypass access controls. You must not use the Service to probe internal networks, perform SSRF attempts (including via webhook destination URLs), scan ports, or exfiltrate metadata endpoints. We may suspend or terminate accounts that violate this section.

Security and reliability

The Service is provided on an "as is" and "as available" basis. We implement technical safeguards (for example, safe-request/SSRF controls, authentication redaction in logs, and secure token handling). However, we do not warrant uninterrupted operation, error-free results, complete detection of all changes, or that notifications will always arrive on time. You are responsible for reviewing detected changes before taking action.

Notifications

Notification delivery is best-effort and may be retried. Third-party providers (email/webhook receivers, Slack/Teams) may rate-limit or reject deliveries. You are responsible for maintaining reachable destination endpoints.

Retention and deletion

The Service enforces plan-based retention for snapshots, diffs, and related payloads. After expiration, payloads and/or diff history may be deleted while metadata may remain for operational integrity. Account and workspace deletion follow the applicable deletion and retention rules described in our documentation and Privacy Policy.

Billing

Paid plans are billed in advance via Stripe and renew automatically until canceled. Plan limits (monitors, intervals, retention, notification channels) apply. If you exceed limits, the Service may restrict creation of new monitors or features until you upgrade. Fees are exclusive of applicable taxes unless explicitly stated otherwise. Diffmon is not a VAT payer in the Czech Republic. Where applicable, the Customer is responsible for self-assessing taxes under reverse-charge or similar mechanisms. Except where required by applicable law, fees are non-refundable and subscriptions are not prorated upon cancellation.

Intellectual property

We retain all rights in the Service, software, and documentation. Customer retains rights to Customer Content, subject to a limited license for us to operate the Service and provide the features you use (including retrieving content, storing snapshots/diffs, and delivering notifications).

Suspension

We may suspend or restrict access immediately if we reasonably believe it is necessary to protect the Service, other customers, or third parties (including to mitigate security risk, abuse, or suspected unlawful activity).

Limitation of liability

To the maximum extent permitted by law, Diffmon is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim arising out of or relating to the Service is limited to the fees paid by Customer to Diffmon for the Service in the 12 months preceding the event giving rise to the claim.

Force majeure

Diffmon shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to network outages, hosting provider failures, governmental actions, or other force majeure events.

Termination

You may stop using the Service at any time and may cancel paid subscriptions from your account settings. We may suspend or terminate access for security, abuse, legal compliance, or non-payment. Upon termination, monitoring stops and data handling follows retention and deletion rules.

Governing law and jurisdiction

These Terms are governed by the laws of the Czech Republic, excluding its conflict of law rules. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.

Changes

We may update these Terms from time to time. If changes are material, we will provide notice within the Service. Continued use after the effective date means you accept the updated Terms.
